There was an emotional epiphany from Derek Kawakami, and a seeming turnaround for Chang, with Darrel excused, and Uncle Kaipo more then likely eventually going the same way. Now I had a tightrope walk yesterday. Joanne, who is a strong member of my coalition was extremely concerned about the testimony I was going to give.<br /><br />I had given a large packet to the council members which I did not reveal to anyone else. They knew exactly what I was trying to say at yesterdays meeting.<br /><br />My scope is very narrow. The facts are these:<br /><br />Any and all individuals that have farm workers or migrant farm labour on their property and do not provide adequate access to potable water, sanitation, shelter and cooking facilities, and for that matter pay at least the minimum wage are in violation of several Federal Laws, and can be severely fined or even incarcerated.<br /><br />IF they are in violation of the Federal Law because the County Law prevents them from establishing safe and humane conditions conforming to the Federal Law, then the County is liable for preventing and or causing these circumstances.<br /><br />For every day a farm labourer lives in a tent without potable water bathing facilities and cooking facilities or goes without wages both are liable, the Farmer and the County.<br /><br />My point yesterday, was that any restrictions on housing farm labourers violates the Federal law.<br />Period. My sense is that this bill is about legalizing what is common (and necessary) practice for farmers. If it isn't legalized then eventually the practice will be accepted but illegal. Forget workers, this is for the owners who bought property cheaply just because it had no housing density, which is the very reason those parcels have remained in agriculture.
