Musings: Credibility and Accountability


As I viewed yesterday's County Council budget proceedings in a state of mind that ranged from troubled to aghast, it became quite evident that Prosecutor Shaylene Iseri-Carvalho is hiding improprieties at her office, most particularly with the POHAKU program, and certain Councilmen are helping her do it.

My assessment came in part from the Council discussion, which I'll get into in a minute, and Shay's own responses and body language. Just the day before I'd sat in the jury pool and listened to Deputy Prosecutor Lisa Arin ask jurors their opinions about accountability, and discuss ways to tell whether someone is lying. And as I watched Shay in action yesterday, I thought, how ironic — and tragic — that the island's top law enforcement official is neither credible nor accountable.

In regard to POHAKU, we did finally learn, from Finance Director Wally Rezentes, that the program “has ceased.” When that revelation caused a stir, he said, “maybe the more appropriate term is suspended.”

And Shay did finally admit that “there may be some operational issues as far as how it's being handled,” which presumably was a reference to her questionable arrangement with Strategic Justice Partners, a firm whose services were apparently secured outside the legal procurement process and that lists first deputy Jake Delaplane as its agent, creating what Councilwoman  JoAnn Yukimura termed "the appearance of double-dealing."

Shay also claimed “we have not spent on any funds on the operation of POHAKU,” which raises the question: so how, then, did she pay for the booth at the farm fair, and the tee-shirts, fans, bags, brochures and other POHAKU promotional materials done up in her orange campaign colors and emblazoned with her photo? Perhaps she meant she hasn't spent any money operating the program, just marketing it.

It's so hard to know for sure because Shay refuses to answer questions or provide key documents until she has a special counsel. Which is why JoAnn and Councilman Tim Bynum were reasonably expressing concern about signing off on her budget, especially the $10,000 for POHAKU, which is no longer operating, anyway. They also wanted to know how she had spent some of the money they'd allocated last year.

But once they started treading into the forbidden territory of the OPA's office, Councilmen Mel Rapozo and KipuKai Kualii quickly moved to stymie all discussion. KipuKai noted the Council had engaged in more "micromanagement" of  Shay's budget than any other.  Ummm, maybe that's because she requested special counsel and at least one of her programs is possibly illegal and potentially exposing the county to liability.

Chairman Jay Furfaro also tried to keep moving things along, telling Councilmembers they'd be getting a briefing on POHAKU in executive session on May 23. Which I understand, and  that's well and good, but what about the citizens who elected all these people and are funding the budget? How will we ever know if money and power are being misused if these matters aren't brought out in open Council discussions?

I had to agree with Tim when he stated, “We have to stop pretending like there's no problems at the prosecutor's office and we have to be able to speak about them.” Unfortunately, he was interrupted by KipuKai saying, “Not now.” Though I suppose the preferred time to bring this stuff would be never, or at least after the election, it does seem reasonable to discuss possible improprieties in expenditures during budget hearings.

County Attorney Al Castillo also abetted the shut up and stall game, claiming he would need to research Tim's question about whether the Council was entitled to know how Shay had spent last year's budget. He also said he couldn't answer Tim's query about whether a department head had to notify the Council before re-allocating budgeted funds.

Come on. You're working as a county attorney and you can't answer something like that off the top of your head? What, it's never come up before? Al did allow that it would be “fair game” to ask Shay how she had used last year's money, but as Tim noted, he wasn't given that opportunity because Shay “bascially pled the Fifth.”

Meanwhile, Al was also making like it would be illegal for the Council to restrict how county money could be used. Indeed, he went so far as to claim the Council had no say in whether department heads spent budget line items on the allocated purpose, or something entirely different, like travel. “It's a question of separation of powers,” Al said, “because you're trying to dictate what they're doing in the department.” 


If that's the case, why bother to make a budget at all? Why not just give each department a lump sum and let them do whatever? And if the Council can't specify how budgeted money is used, and isn't entitled to know how it was spent, who exactly is accountable to the public for the use of tax monies?

JoAnn then made a motion to cut $10,000 out of the prosecutor's budget since POHAKU is no longer operational. Councilwoman Nadine Nakamura, who has thus far been disappointingly mum on this topic, finally spoke up, saying “a lot of allegations have been thrown around” about POHAKU. “It's really important to me to get to the bottom of this. There may be funds that have been misused.”

Ultimately, only Mel and KipuKai voted to give Shay the ten grand, anyway. 

Then JoAnn and Tim turned their attention to a job currently held by Lianne Parangao, a woman who previously worked for Council Service before moving over to the prosecutor's office as a victim witness counselor. Thirty days later, her job title was changed to program assistant. Tim and JoAnn wanted to know what she was doing.

Well, aside from being the most active person working on Shay's campaign, Lianne supposedly is also handling all the diversion programs: teen court, drug court and POHAKU. At least, that's what Shay told the Council. Except she didn't mention that both teen court and drug court are actually run by outside agencies, and POHAKU is pau. And since there was no follow up, the question remains: what, exactly, is Lianne doing to justify her $55,000 annual salary?

But we'll never know, because all but Tim and JoAnn voted to keep the position status quo. Because status quo is what the county does best.

    Joan, don't forget the Humane Society debacle - what's the county's tab on that? When are Shay & her sidekick, Delaplane handing in their walking papers? Too many costly blunders!

  4. Isn't there ANYTHING to talk about on Kauai except "small town [island]politics" and hand-wringing over various "desecration" (relative to a certain line of thought) of land, culture, whatever.

    Doesn't seem too "eclectic" to me. It seems like the local political news channel plus how "everyone else" is ruining (relative to your sensibilities) the island.

    The take-away message seems to be that Kauai is a deteriorating hell hole.

    But, then, when getting the opinions of others, it's not so bad after all, once you rise above the petty politics and "we're doomed" hand-wringers.

  5. It's obvious that there may be improper procurement procedures & a the Deputy Prosecutor may have a conflict of interest. That's probably why they can't discuss it in public; it will open the county to more litigation.

    We really don't need to crucify public officials if mistakes were made in procurement & hangling. If POHAKU is a good program, let's keep the program!

    As far as Joann & Tim micro-managing a person in OPA is concerned, they need to get a better life. That should be a department head's discretion.

    Let's clean this up and Let's move on, people.

    1. Pohaku is a farce. The participants pay $200 to Jake's bosses at Strategic Justice, attend a class and the charges are dropped. Minimal to zero community service. Pohaku is being used to run Shay's campaign and line the pockets of Strategic Justice. That's why Shay won't answer questions.

When, in the history of this state, have you ever heard of the prosecutor taking the fifth? That fact alone raises so many red flags about Pohaku. Keep up the good work, Joan. And many thanks to Tim and Joann for at least trying to get to the bottom of this scandal.

  8. Wait! No $ was spent on Pohaku? What happened to the $200 that EACH client had to fork over BEFORE getting in? What about the people who are currently in? & did she FAIL to mention the highly valuable Jail Diversion Program is likewise "suspended"? Why? Prosecutor's don't soend a dime on this yet it was stopped. And even her DPA's can't answer simple questions. & we need, & demand, answers!

  9. Thank you Joan for keeping us updated as to what is happening with the "Pohaku" program. It is sad that it hasn't been straighten out yet. "What goes around comes around" I truly believe in this Shay treated Craig very bad when he was the Prosecutor and she on the Council. I think she is just getting a little of her own medicine but is having a hard time swallowing it.

Councilmember who was set up by prosecutor with trumped up case asks questions. Prosecutor takes fifth. Councilmembers who work for or used to work for prosecutor try to cover up for prosecutor.   21. The County Council should be allowed to ask Department Heads questions about how money the Council approved has been spent. There has to be a checks and balances system, otherwise, there's room for fiscal abuse.
    When someone asks for legal representation and refuses to answer simple questions about how taxpayers' money is being spent, one has to wonder what they're hiding.

Maybe they were paying attention to what Koller was doing IN KPD HEADQUARTERS when Chief Perry tried to get into his office and was refused by Mark Begley who said "i'm not taking orders from you, or the police commission, I take my orders from the County Attorney office (Koller).

  39. Mel and Kipukai sued to uphold the County Charter. According to them, shall means it's mandatory. The charter says that all county contracts shall be signed by thr mayor,finance director and the county attorney. Violations are misdemeanors. Will Mel and Kipukai demand that the charter be enforced if the prosecutor contracted with Strategic Justice without getting the required signatures? Chief Perry, this is a no brainer. Just look at the contract and decide.

  41. The charter violation can be easily investigated. If the contract with Strategic Justice was signed by the mayor, finance director and county attorney, then the charter was not violated. If the contract does not have their signatures, the charter was violated and a misdemeanor was committed. Will Mel and Kipukai, staunch defenders of the charter, insist on its enforcement? Will Chief Perry investigate? Or will they try to sweep this under the rug?

  46. Anonymous at 12:58PM, this may seem "manini" to you, but think about it. Shay is the Prosecutor, an elected official. She took an oath to be honest, ethical, law-abiding. As such, she should be held to a higher standard. We as taxpayers have a right to know how our money is being spent. She should not be able to dodge bullets. She should just answer the questions posed to her. The way she's being so evasive, I'm thinking she's broken the law and needs to cover her tracks.

Is that not illegal and violation of county charter, hawaii rules of professional conduct, ethics violations, procurement violations Shayme never Ends its a long list of criminal activities. He is not the only private investigator that can issue summons on Kauai. Is these monies a bribery assets to fund another Rapozo campaign to be King Mayor of Kauai?     1. You just don't know how Young Bros is in the shipment of drugs, guns, and other illegal activities. They have been busted a few times by the feds and almost lost their business more than once. How do you think the flying cocaine flew over the shipping dock fence, it doesn't have wings. Kauai needs TSA or the coast guard with sniffing dogs at shippping docks and landing strips. Knowing is only half the battle.

  55. I love Joan's writing but sometimes Andy is pointed and funny:

    No one expected much in the way of discussion regarding evil mastermind Iseri's all-purpose now-you-see-it-now-you-don't combination misdemeanor diversion program/reelection campaign tool. She's been busy lawyering up and taking the fifth so to no one's surprise, with the aid of her Council(hench)man Mel Rapozo and his refuse-to-recuse sidekick Kipukai Kuali`i, her council nemesis Tim Bynum and his second JoAnn Yukimura once again failed to get any "answers" to the same kinds of questions all the other department heads had to answer in order to receive their yearly budget appropriation.

    Lesser Iseri sycophants Council Chair Jay Furfaro, and Councilmembers Dickie Chang and Nadine Nakamura managed to help shut things down out and keep the relevant allegations of crimes and misdemeanors from the public's ears and eyes, running out the clock without any repercussion to the budget... and of course the local newspaper has been too busy promoting flower shows, defunct food banks and poisonous GMO corn to notice the P.O.H.A.K.U. mess.

  56. watching the government chanel - can anyone tell me what Mr. Tommy does other than wear a cross? He couldn't even answer the questions about the CIP - not sure he even knows what it stands for and he makes how much money? DOing what again? I'm pretty sure he is one of the non-competent employees brought in by King B -

    oh can anyone provide a list of employees brought on by King B who have the actual experience and education to match the job description, before it was changed?

    How many more entry level, non educated people are you going to bring in King? More useless staffers to serve your own means, not those of the people.
