Musings: Debatable

I would have liked to have attended tonight's debate between Prosecutor Shaylene Iseri-Carvalho and challenger Justin Kollar. Except my sister had just arrived after 15 hours of travel, and I wasn't gonna subject her to that.

But since she's a political junkie, I filled her in on everything that's been happening with Shay as I made dinner and waited to hear the debate on the radio. She responded with wide eyes, small gasps and exclamations of “what?” and “you're kidding!” before ending with, “On what possible leg could this woman stand other than she's a local?”

Shay apparently agrees that's her biggest selling point, too, because when the debate came on the radio, Shay started with, “I was born here.” Justin, on the other hand, led with, “I'll repair damaged relationships.”

As the debate progressed, I really had to wonder who came up with some of the questions, like the one about perjury, and another on what's your stand on public intoxication? Ahem.....

Then there was the question about violations of the county charter — you know, like the ones the Office of Prosecuting Attorney is being investigated for — with Justin saying it could be a misdemeanor in some instances. Shay, on the other hand, came out swinging, saying she'd gotten a complaint about the $1 million that is reportedly missing from the budget and vowed, “We will do a full and fair investigation.” No doubt. Anything to get the spotlight off her own misdeeds and jab her enemy the mayor at the same time.

Speaking of misdeeds, Justin mentioned a couple of times how Shay's management style has cost the county “hundreds of thousands of dollars” in settlements to former employees she has “mistreated, maltreated and abused.” He said there have been “an unprecedented number of claims against the prosecutor” — I know of four that were settled — and that would not be the case under his administration.

Justin also dropped a bombshell about how this was likely the first time ever that federal Equal Employment Opportunity Commission investigators have come in and made findings about racial harassment in the OPA. Oh, really? Can't wait to learn more about that.

Justin kept hammering home the point that turnover in the OPA is running 150 percent — four times higher than any other county in the state, and a rate previously unheard of on Kauai. He said turnover is hampering OPA's ability to do its job. As an example, it has pretty much abandoned prosecuting drunk drivers and instead plea bargains those cases. Shay responded by saying those were “low-level cases” and she was busy with capital cases, as in murders.

“Do you have a lot of capital cases?” my sister asked. “No, I replied, “because the cops so rarely can solve them or make an arrest.”

Justin made the point that “we've never seen another term of office that's been so riddled with conflicts [of interest] or had more recusals.” Shay, however, claimed her office hadn't been forced off the Lara Butler Brady horse abuse case. Yeah, that's technically true, but the OPA only withdrew because it knew it otherwise would be yanked off.

If I'd been there, I might've had to yell out, or least mutter, “bullshit,” when I heard Shay's response to a question about prosecuting illegal transient vacation rentals. She claimed that these issues had to be referred from planning and said, “It's quite unfortunate that since we prosecuted a Councilman we have received almost no referrals from planning... and zero vacation rental violations.” As I've reported previously, based on conversations with Planning Director Mike Dahilig, OPA can go after any zoning issue it wants. It does not have to wait for a referral from planning. 

Heck, she went after Councilman Tim Bynum, and his zoning case was never referred from planning. Instead, Shay nosed around after seeing a police report filed by someone staying at his house. Plus I recall First Deputy Jake Delaplane telling me the OPA was going after TVR owners on ag lands, and had filed zoning violation charges against numerous other landowners when Tim was charged. But even though Jake  promised he'd get more details, he never did.

Shay also bragged that she's been working to narrow the definition of who is eligible for medical marijuana, claiming “97 percent of medical marijuana users do not suffer a debilitating condition.” Justin's reply was, “I'm uncomfortable putting the state between a patient and his physician.”

They both agreed it should be a crime to block a public access, with Justin pointing out Shay had gotten contributions from the big landowners, but he was beholden to no one.

Shay threw out a lot of swell-sounding statistics, but Justin countered that statistics “don't do anything to keep a community safe.” He said that three-quarters of all cases are settled through plea bargains, but Shay still counts them as convictions. “I don't think people in the community feel like we're getting 99 percent of the bad guys off the street.”

My sister and I agreed both candidates sounded confident. She thought Shay sounded defensive, but Justin had a less-pleasing voice. I thought Justin got some good points in, and Shay held her own well. 

Still, as I listened to Shay talk about the need to prevent bullying and harassment, I couldn't help but think of the employees who successfully settled harassment claims against her. When she talked about hate crimes, I wondered, so what, other than hate, motivated you to go after Tim? And when she said the “hate and mistruths” started by her opponent should stop, I flashed on her supporters calling me a bitch and evil and wishing I'd get a bleeding ulcer as they all the while madly spun their version of the truth.

But when she said, “You need someone who can stand up strong and be pono,” I had to agree. That's exactly what we need. And maybe one of these days we'll get him or her.

Oh, Shay, and since you're so into “honesty, openness and transparency” – could you please give me those public records I asked for, the ones that Office of Information Practices directed you to turn over no later than this past Monday, the ones that would tell us how you paid for all the POHAKU paraphernalia?

    Thereʻs ample opportunity for scamming a lawsuit to split a settlement from the county.
    And if the public knew what the county attorney and council are agreeing to on some of these suits, they would have been out a long time ago.

    He doesnʻt know squat about Hawaii. That is a fact.

    Shaylene is another story in a different way.

    So, once again, we have no choice for election.

    Frankly, Iʻd be worried if Kollar was PA.

    Iʻm not an attorney but I heard unprofessional comments and possible ethical violations coming from both of them last night.

Pick your poison, the MSDS has Shay's picture as the most deadly and toxic substance in the county of Kauai. It's too bad that the EPA can't clean the corruption mess in our county offices, now that's a Superfund site if i ever seen one.

    They say the exxon mobil spill was the largest most dangerous human caused environmental disasters. The county of Kauai OPA office under Shaylene's Rule will be known as the most toxic human caused disaster in the history of Hawaii.

Probably a cool million but it's not as close as how much the bike path is ripping people off at 4 million per mile, the wailua bridge bid was 1 to 3 million but final cost was 30 million, 100k for consulting of a gym, nearly another cool million for KIUC consultants, don't know how much the tax payers paid for stolen gas, and so forth.

      The estimate for the paving of the old haul cane road from mauka of Aston to Hanamaulu would be a few million dollars. This road would alleviate the traffic congestion and help create a steady flow of traffic, just like the kapaa bypass.

      Kauai needs to rid ourselves of Nepotism and get qualified people who can make decisions that serves the needs of all Kauaians and not concentrate on just a few bike riders or a group of weathy aristocrats.

  54. Two things bother me about Kollar:

    1. His inexperience.
    2. He used the advancements provided by Shaylene and our OPA to leap the ladder.

    If I were Shaylene, I would be be pissed that someone stepped on me after I gave them a promotion and instead of saying thank you and working to learn more and gain experience, I tried to take her job away.

    But she didnʻt say anything about that.

    Just an observation weighing both sides. That is not a character trait of someone I would trust.

  65. Who cares what she looked like? This is Hawaii and wearing lei is a custom which makes us unique. Focus on her work and character instead. There are serious discrepancies coming out of her office. That's where the dialogue should be focused.

    Likewise, who cares what Justin looks or sounds like? Calling him a pedophile is ignorant. Yes he lacks experience but for me its all about ethics. Which candidate has the integrity and moral ethics? Shay has shown a lack of these qualities and after the debacle w/ the Laura Butler case, Bynum, and now Pohaku, confidence is lost.

  67. Joan does her research. Too bad OPA doesn't comply willingly when information is requested by her. Shay had opportunities to clear the record yet she chooses NOT to be transparent. Her behavior is perceived as suspicious. When you're an elected official, perception is everything. If she were above reproach it wouldn't be a problem to disclose information. What's the public to think when she refuses?

And I like how Joan has reported and commented negatively on Joann and Tim and positively on Mel and Kipukai when she thinks it's important. Read her coverage of the vacation rental issue or the bike path. Tim got pounded.

Carl Ritchie was a convicted pimp who was allowed to run the old free store in kapaa where he had and they sent him female community service workers. This happened on Shay's watch and what former kpd officer shay is very close to and you will see the connection.

    If you look back at the police chief's debacle, when certain GOB members on the police commission were able to pick a puppet police chief and get rid of two chiefs that did not follow the orders of the Mafia. Read KPD blue


    When council members go against the GOB, they will feel the wrath of the Mafia.

    There were a couple good police commissioners who fought and lost against the GOB Mafia because they were syndicate commissioners on the board.

    Rolf Bieber was targeted after he made some startling revelations and was subsequently replaced with a very powerful fellow, scary kind make you disappear powerful.

    All of the crime victims counselors and deputy prosecuting attorneys were replaced because some were syndicates and others were grooming to be. They just weren't apart of the same team of Mafiosos.

    You have to understand right now that the the fight for power on Kauai is between two powerful groups. You have total division in all departments and this creates a safety hazard for the lives of all people on Kauai.

    Kauai is NOT SAFE with these two groups in power or fighting for power. If you believe that you are then you don't understand what is going on in Kauai's Underworld. Most of the Crime on Kauai is connected to these people. You just have to take the time to identify who they are and what team they are on and you will understand the destruction they have caused on Kauai.

    Why do you think Kauai people never showed to the PA's town hall meetings. The whole island has lost trust, faith, and confidence with these people that are sworn to hold an oath of judicial service and this means all departments.

    I just hope that the GOB won't be able to steal the election by rigging the ballots at the polls.

    I've seen on Joan's blog where the so called good ol boys boasts of how they have all the money, power, resources and people in place to foil an attempt to dismantle this group of families.

    It's worrisome and bothersome to me of the things that has gone on here. If the people that are in trusted leadership positions are in a so called gangs of Kauai then I hope the FEDS are paying attention.

Considering that EEOC complaints are brought against an employer, and the elected prosecutor is the head of that office... regardless of whether she personally did the harassing or not, she is the one to answer for it. The 'buck' should stop with the PA, they're the highest paid and arguably most powerful law enforcement official in the county. There should be no excuse making.

    Also, wasn't Erin Wilson one of the settled EEOC cases against OPA? There really shouldn't reasonably be the question of whether there ARE any EEOC cases. it seems pretty clear there was.

  94. Doesn't matter whether most people agree with anyone in particular. These things are not settled by popular public opinion.
    IT does matter that the elected prosecutor is effectively in charge of OPA, and controlling their employees, and creating a work environment where these types of complaints don't happen.
    It matters that there is one definite example, and there is a published record where the victim blames the PA, and the management of the OPA, and it does matter that there was a settlement.

  95. The prosecutor was asked questions in which she refused to answer then lawyered up and she refuses to produce receipts, expenditures, expenses and the whole logistics of a program that is in question which is POHAKU.

    The program was identified as a hand shake deal that violates the state and county procurement process. She then sends her right hand man to ask for a keiki version but refuses to answer questions regarding the program.

    Kauai has seen this before in the Kauai food bank scandal, the housing market scandal, the planning department scandal, and other bank room over cold beer deals.

    We simply ask the PA to be forthcoming with these documents. If she was in the private sector and refused to give the owners the proper documents then she would be FIRED and or face criminal charges.The REFUSAL to give what the public wants shows that you are hiding behind something and are responsible of subverting the liberties of the community of Kauai.

    2. EEOC cases and settlements from the OPA has cost the county of Kauai hundreds of thousands of dollars. In simple terms a employee violated equal employment opportunity laws in the OPA and there were settled with large sums of tax payers monies.

      There is a independent commission that reviews complaints and validates them or throws it out. It was like when Pluegher, State of Hawaii, and the county of Kauai was found guilty and responsible for the deaths of the 7 people and the unborn child during the Koloko Dam breach and paid millions of dollars for their negligence.

      I would propose to the county council of Kauai to remove the harasser(s) from their position(s) that they have sworn an oath to uphold. This person(s) are liabilities to the county and state as well as creators of a hostile work environment.

      I request for a agenda item to discuss this matter asap! Your constituents are demanding to get to the bottom of this ordeal that has been kept secret. The citizens deserve answers and the victims deserve restorative vertical prosecution from the culprit(s). You can plead the fifth all that you want to but we recognize guilt when we see one.

      So Kauai let's put in letters requesting our county council members to review, discuss, and decide on the termination of the harasser(s) in the OPA that has caused Kauai tax payers hundreds of thousands of dollars in EEOC settlements.

And the fact that word is out on what an easy tap this county is for a sue job; there could have been some mamby pamby newbie lawyers at OPA that saw a suit in some little thing that most normal employees would have shrugged off...because they realized they were too incompetent to continue a career as lawyer.

    But hey why not take some free easy money instead of going to work everyday. Got to remember, if these were attorneys they were out for a buck and had to pal-up to make their charges stronger.

    I am not defending Shaylene cause I do not know the particulars but I smell a rat. How come this never happened before? Before she got back there was some pretty unsavory characters from the mainland in charge that didnʻt know their asses from a hole in the ground. And Iʻll bet there was plenty of residual clean-up after she got back too.

      In any private sector a person accused and found guilty of EEO would be disciplined and or terminated and the fact that there are multiple complaints and settlements only streghten the accusers cases.

      The recent most famous Sandusky molesting and abuse cases are a perfect example of how the real law should punish the evil doer. Will this happen on Kauai? With recent memory of the Kusaka koloko dam incident and the Dr Speer case, it looks like you can get away with anything on Kauai just as long as you're connected. Everything is unsolved, covered up, superficial, and unattended here on Kauai. Drugs and crime run out of control because the people we trust are protecting their family, friends, and bootlickers.

Tim's antics on the council blocking the OPA from receiving federal and state grant money is such obvious payback for having justly been prosecuted for violating the kauai code and having an illegal apartment. He won't be reelected. It was bad enough that he's a scofflaw. It's even worse that he lets his personal pettiness disrupt county business and hurt the children and unfortunate adults who would have benefited from the programs he killed.
