Musings: Dances, Political and Otherwise

It's been delightful these past few mornings to watch brilliant Venus and the crescent moon dance in the lavender pre-dawn sky. But today Venus pulled ahead as a sliver moon, new tomorrow, struggled to emerge from a cloud bank on the horizon.

If you thought the political dance between Councilman Tim Bynum and former Prosecutor Shaylene Iseri ended when his case against her finally settled, think again. With her allies — Councilmen Ross Kagawa and Mel Rapozo — reluctant to pin the blame on the donkey, they're now focusing on County Attorney Al Castillo's office, which has his enemies — Shay and Councilman Gary Hooser — piling on.

As ably reported in today's The Garden Island, Mel wants to release the Council's executive session minutes on Tim's lawsuit, which I would certainly love to see. Let's hang all the dirty laundry on the line.

Hawaii News Now is doing its part, reporting that Tim will receive more $250,000 — it's actually just under $300,000 — and rehashing some of Shay's previous “highly-publicized misconduct incidents.” The report also noted that “the settlement is significant because prosecutors are usually immune from such lawsuits.” It then quoted Honolulu defense attorney, Victor Bakke, who wasn't involved in the case, as saying:

For the county to give up their immunity defense and settle for a sum of that amount is a good indication that not only did they not have a good case but they would be punished even more.

Another political dance is under way at KIUC, where we're voting on three new members of the Board. If you haven't voted yet, your ballot envelopes are probably glued shut from all the rain, but you can still vote on line or over the phone.

I asked a friend recently who he voted for, and at first he didn't want to say, because he thought I'd get mad, but he finally fessed up: he'd cast his ballot for Jonathan Jay, Adam Asquith and Jimmy Trujillo, whom he characterized as the “three rebels.”

Except they're not, I told him. They're just like the county folks who are wasting our money on frivolous lawsuits and using the process to settle personal grudges. All you have to do is look at their “to do list” for the KIUC Board, where the number one priority is “Cre­ate & Hire a new Com­mu­nity Engage­ment Department.”

Really? Their top priority is to replace community relations director Jim Kelly, one of the best things that ever happened to KIUC? And why? Because he's the only who has had the balls to stand up to those guys and call them on their bullshit, including monopolizing the KKCR airwaves (where all three have programs) with KIUC-bashing.

Btw, the only KIUC candidate who was never invited to be a guest on KKCR was Chuck Lasker, who is hated by the station's “red shirts” for his pro-GMO stance. How's that for fairness and equal time on our "community" radio station?  [Update: One of the programmers said she did call him but did not get a response, though he told me he'd received no communication at all.]

One of their other proposals, I told my friend, is to institute free smart-meter opt-outs, even though the members just rejected that. Another goal is solar hot-water on more than 90 percent of all roofs within a decade. Which sounds great, but who is going to pay for that? And how likely is that people who already paid for rooftop solar will want to subsidize that cost, especially when they didn't want to spend even $1 per month to pay for other members' smart-meter opt-out fees?

It'll never fly, my friend acknowledged.

Exactly. But that's the kind of pie-in-the-sky crap they throw out to make themselves look good. Meanwhile, they haven't been attending Board meetings or otherwise doing anything to get akamai should they actually win.

I know they'll never get elected, but I just wanted to make a protest vote against the status quo, my friend said. “You used to be a dreamer, too.”

And I still am, I told him. Only my dream is for people who truly want to serve the people — folks who aren't motivated by ego, pettiness, retribution and revenge. 

Finally, we continue on this island to dance around the tough question: what the hell are we gonna do with our ag lands? The proposed new dairy is already getting thrashed, though many of the bashers don't even know exactly what's planned.

I don't know if the dairy can fly, or if it's a good thing. Questions still remain and need to be answered. But it's important to resist these knee-jerk rejections of every agricultural proposal that requires more than an o'o stick and imported bat guano.

Because I'm cynical enough to see Grove Farm — now clearly a land-banking company — going to the state Land Use Commission and saying, hey, we can't make ag fly even on our Important Ag Lands with a project financed by a billionaire who doesn't care if he makes a profit. How the hell do you expect us to make ag work on our other lands? We need to have them reclassified.

We could just end up dancing with developers, instead of dairies. And while new management models may keep the latter from stinking, I'm not convinced the same holds true for the former.

I wouldn't say that those who want the facts be known about the
Bynum suit are Shaylene's allies! I am certain, they want the TRUTH. Are you implying that the facts will give Shaylene some edge to the entire matter? And yes, people are bashing the dairy plans--and so have you---you mentioned about the poor planning, no shade for the cows, etc.

There's a difference between bashing and raising questions and concerns. I'm seeing both.

As for Shay, releasing the ES minutes isn't going to give us "the truth" about the case, it will only disclose the council's discussions regarding it.

If the Council waives executive session privilege, anything in those minutes becomes fair game for the "sue the County" crowd.
Talk about making a bad situation worse.
It would be fun to see the executive session minutes, but the Council releasing them is akin to legal suicide, shooting yourself in the head so everyone can see what your brains look like.

Timmy knew how much the County threw at past lawsuits. It seems approx 300K is par, oh gee, and another 500K County legal bills and pro'ly 200K for Shay defense.
Not bad for the the CA and Council brain trusts, close to a million buckareenies for legal tomfoolery and then pay out $300K to settle a BS case. Maybe everyone who gets cited by planning or building should sue, Timbo HAD an illegal rental. FACT.
I think it is good that Kauai is trying to stop a Dairy. How dare some one use Ag land for Ag, that is ridiculous.
Ah kin taik thet 5 hunnert akres and make 100 wunnerful ag homesites. Then we can have real Ag like a little goat cheese, kale, a few Rambutan and such. The only way for Ag to work on Kauai is to pay 1 to 5 million for Ag house and lot, and produce a few veggies, get some hippies to do day labor and take yer 500 bucks of farm produce to the Farmers Market. Fergit that big farm stuff.
With Timmy's whiny BS, Gary's flaming lies and now a new brigade of Dairy milyun li'l fistees, I am beginin' to thin' that it is time for all these crybaby Howl-eees to go back from whence they came...enuff is enuff.

Gosh, you sure seem to have got yourself worked up and on a roll, with my efforts at reform for KIUC.

Why is this?

And if you are so impassioned, why don't you seem to have the time to do any follow up to clarify or confirm your impressions to see if you are even barking up the right tree?

I just don't get it.


But just so you can see this in black and white from me personally:

I never said, and no where in my work does it say anything even remotely like getting rid of Jim Kelly. I have never even considered it. You putting it in print is the first time i have ever heard anyone mention it. Nor does it even sound like a good idea to me. So where did this come from?

Answer: You made that up. 100%.

What I was getting at, over at www.BuildaBetterCoop.com was that KIUC should make it a higher priority to engage with the community, and give us all tools to more productively engage with our co-op in such a way that KIUC gets a better benefit from all the akamai people who live on Kaua`i, and so we can all get a better benefit from having a cooperative vs. a for-profit electric company on Kaua`i. This way, we can move forward faster as an island together.

Does that still sound nefarious or self-serving?

Perhaps me articulating this vision of a stronger, more deeply connected community utility does not fit well with your narrative of understanding that I am vindictive and petty, or whatever other opinions you seem to rigidly hold, but that is OK, because your narrative is just that - a story you made up; a way that helps you think you understand things - but one that happens to be quite false.

As are several other specious characterizations in your KIUC efforts - they fit in with your 'frame' - but are not supported by the facts.

Why are you so fiercely insistent in conjuring and then shadow-boxing with this deeply flawed narrative?

Hmm.... You want folks "who aren't motivated by ego, pettiness, retribution and revenge." Well, nearly all humans are susceptible to those very human flaws at... Many great leaders certainly had such flaws..Franklin Roosevelt, Bobby Kennedy, Churchill. We're all flawed, and that includes you and me. You seek the ideal of perfect, selfless character. There is plenty of good in people who are imperfect. They can accomplish good, and sometimes great, things while still having such flaws. As Paul Achitoff (someone I have never met) pointed out, we all have an ego. I find it hard to believe this doesn't include you. And if it does, how can you hold others to a standard you can't adhere to either?

Musings: Mel's Double Dipping
Councilman Mel Rapozo, one of Prosecutor Shaylene Iseri-Carvalho's staunchest allies, has been receiving regular paychecks from her office — even as he accused others of having a conflict of interest.
Mel's company, M&P Legal Support Services LLC, was paid $43,026.20 to serve subpoenas for the Office of Prosecuting Attorney between July 2009 and May 2012, according to a review of public records.
Throughout that time, Mel has actively defended and supported Shay during Council sessions, including some that he chaired. He also has repeatedly and publicly accused County Attorney Al Castillo and Councilman Tim Bynum of having a conflict of interest with the Office of Prosecuting Attorney, to the point of cutting Tim off when he was questioning Shay.
Mel, a former police sergeant who left KPD following the Monica Alves Fanta-See Express scandal, first entered into a contract with the OPA in June 2008, under former Prosecutor Craig DeCosta. He was hired to serve subpoenas to witnesses of domestic violence.
In May 2009, Shay replaced the term “subpoena services” with “legal documents,” added an additional $14,000 to his contract and extended it to Sept. 30, 2010. It was extended again, until Sept. 30, 2011, and then again. His most recent contract expired on Sept. 30.
In 2009, Rapozo was paid $16,580. In 2010, the total was $12,505. In 2011, it was $12,890. So far this year, he has been paid $1,851.20 for services provided in January, February, April and May.

Musings: Honor Among Thieves
A former employee has filed a claim against Kauai County for $356,400, alleging corruption, misconduct, ethics violations, retaliation and a hostile work environment in the auditor's office.

Ron Rawls, a former staff internal auditor, contends that county Auditor Ernie Pasion and former Prosecutor Shaylene Iseri-Carvalho doctored a county fuel audit investigative report to make their political enemy, Mayor Bernard Carvalho, look bad.

On Aug. 4, 2011, the Auditor's office received an anonymous complaint about Iseri-Carvalho and Delaplane misusing county vehicles and fuel. Rawls had previously become aware that other employees were taking county vehicles home, increasing the likelihood of improper personal use.

At a mid-August meeting with the McCorriston law firm, Rawls presented the information about the take home vehicles. Investigators “were unequivocal in their position” that all the fuel cases should be reviewed simultaneously to avoid the appearance of selective prosecution.

However, Pasion specifically directed McCorriston to investigate only the mayor and a parks worker, and none of the other employees. Rawls contends Pasion was trying to derail any investigation into Iseri-Carvalho because they are close political allies, whereas he has observed that Pasion “openly disdains and disparages Mayor Carvalho.”

After receiving the McCorriston reports in April 2012, Rawls confronted Pasion about his misconduct and suggested he recuse himself. In response, Pasion “lashed out” and removed Rawls from the take-home vehicle audit, then began excluding him from closed-door staff meetings. Pasion and Nakazawa also ridiculed him in front of another employee with false accusations about his work.

Will Mel investigate these allegations?

The disconnect is what the judge said it was. It is a feud. And even after hearing that it is a feud from a Federal Court, they will still continue to fight - the two camps - Mayor/County Attorney versus Council/Former Prosecutor. Both sides are part right and part wrong. They need serious hooponopo, but you can not settle a war with someone who loves the war.

It almost is like domestic violence. It is like a pattern of irrational fighting that even the Court cannot control. Can't we all just get along?

The rest of the flock don't relaize that KIUC is in for a challenge.

I would not go on KKCR if they invited me, with their clear bias and ambush tactics. But KKCR didn't know that when they chose not to invite me along with all the other candidates. I only found out they had invited others when Stu Burley asked me if I'd accepted their invitation. I mentioned this to you, Joan, not because I wanted to be on KKCR, but to show yet another example of how KKCR uses public funds to promote a specific political agenda.

Felicia Alongi Cowden said this on the KKCR Facebook Page when asked why I wasn't invited: "Because he did not return my phone call and did not give an e-mail. His website did not have a contact point and he seemingly either left facebook or blocked me. It wasn't for lack of trying. Jim Kelly was told that he was not successfully reached. Chuck has made no effort to contact kkcr to my knowledge and we have said repeatedly that all are welcome. The incumbents declined the opportunity. Effort has been made."

Felicia never called. To be sure, I just looked back at all incoming phone numbers for the past month and there were none I did not recognize. My email address is all over SocialKauai.com. Chucklasker.com has a Contact link at the top and a contact form on every inside page. So which website she claims to have looked at I don't know. Even if she was looking at the wrong website, a simple Google search on my name shows dozens of ways to reach me. "Effort has been made" is a joke.

"and he seemingly either left facebook or blocked me" - well, in Felicia's slanderous comments about me on the Change.org "shut Chuck up" personal attack petition, she states she blocked ME, so again, another lie.

Jonathan Jay sent out an email to "to all the public affairs programmers at KKCR" with all candidates phone numbers and email addresses (thanks JJ), yet Felicia laughably claims that she didn't get it.

Her statements don't add up. I would respect Felicia more if she said, "we hate Chuck because he disagrees with us so we decided not to invite him," than to see her spinning a web of lies to deny KKCR's political bias.

If KIUC is doing all of this then why hasn't the rate payers seen a reduction in their Kw per hour rates.

If KIUC is saving money on fossil fuel and will soon shut down that really outdated and expensive port allen plant then where is all the mula going to?

The smart meter customers haven't saved a penny from the installation and they don't know that eventually it will cost them even more. The over charging and fleecing of the analog metered homes is a bs way to show that the smart metered homes are saving $10 dollars a month.

Green energy is going to sell KIUC electricity at a cheap rate and the KIUC customers will not see a discount and in fact will see their rate increase.

Green Energy LLC will shut down KIUC and it's a great thing for the residents and businesses on Kauai.

KIUC is not nonprofit, it's more like a bank or like wallstreet. Their in the business to get every since dime and penny from the citizens, even if they have to scam them. KIUC is a SCHEME.

And how do you expect Green Energy LLC's to shut down KIUC With it's 7 MW bio mass plant that is under a PPA. Do you really think investors would have invested in the project without a PPA with KIUC. KIUC has an excellent working relationship with the Green Team.

The Green Energy project can be considered firm power that can potentially run 24 hrs a day. A great asset in KIUC's portfolio.

Did you know that they are going to build substations?

Competition is good for the community. Kauai needs more competition to offset the monopolies.

Imagine if we had another cable company or better yet another airlines that would compete with Hawaiian airlines.

The superferry would have worked if they only had gambling on the ships. Imagine an industry that would create jobs and travel throughout the state. It would be able to fund so many other social programs that it would offset the cons.

Hawaii residents spend millions to billions of dollars in las vegas and other gaming states.

Teachers could get higher pay, children could receive free lunches, state wouldnt have had to raise property tax, rail would have been paid for, roads fixed, no raising of vehicle registration fees, driver's license fee hikes and so on.

I remember waimea and molooa dairy farms and those failed. It was dreadful to drive through those areas and only create few jobs.

I think green house farming and aqcuaponics would work out better. Imagine if we could grow 75% or more of our food here on Kauai. If the paypal guy would invest 17 million on that idea then I believe that would work out better than a dairy farm.

Green Energy is funded by the federal government. It's not going to cost KIUC or it's rate payers a dime.

Which means KIUC will generate even more profits from the savings that they won't have to spend on fossil fuel.

It's like the federal funding from the smart meters to solar farms; it's all federally funded. All it means is that KIUC will profit even more when it's all said and done.

KIUC will still charge it's customers half a dollar for every kilowatt hr used, when in all of america it costs 1/3 of that for electricity.

Who's fooling who and will KIUC ever drop those outrageous rates or will the top of their chain get huge raises and bonuses as did the dirty banks, fannie, freddie, and wallstreet did.

So why have we "not seen the savings" from the renewable energy projects yet? We have. Energy costs have gone UP throughout Hawaii. Let's look at numbers since 2009. The KIUC Dec '09 residential rate was $0.34598 per kWh. The Jan '14 residential rate was $0.42344 per kWh. That's a 22.39% increase. But for the rest of Hawaii, they've seen a 50% increase! That's twice the increase we've seen, so THERE is our savings. KIUC is doing awesome regarding rates.

The only ways KIUC can lower rates is cheaper energy sources, higher efficiency and cutting costs. The smart grid will help (although not as much with 10% non-participation) by allowing higher efficiency through load management as well as finding energy-loss areas, inefficiencies and energy hogs. As the new renewable energy projects go on line by the end of the year, we'll see even more savings. Those savings might get eaten up by oil prices if they skyrocket, say, due to a Ukraine/Russia war, but it will be better than NOT having those savings.

There is plenty to criticize KIUC for. Rates is not one.

The Washington post report finds fraud, embezzlement at more than 1,000 non-profits. This article was written on oct 27 2013.

KIUC needs to be thoroughly audited.

If you have nothing to hide and would invite a full disclosure to the public then I challenge KIUC and it's board members to open it's books to the federal government.

I have seen lots of nonprofits CEO's and other top employees get outrageous salaries and use funds for luxury items that are not needed and expensive fully paid meeting/vacations.

What is with the colorful magazines and the donations to all kinds of other nonprofits org's? Are KIUC employees getting bonuses (like how banks rewarded it's employees for bankrupting itself)?

Is this how KIUC offsets it's profits to be called a nonprofit?

Residential electricity rates rose in April on all islands except for Hawaii island.

Hawaiian Electric Co. said a typical 600-kilowatt-hour bill for Oahu residential customers rose by 51 cents to $204.25 in April. The effective rate for electricity in Honolulu is 32.6 cents a kilowatt-hour in month, little changed from March.

Elsewhere in the state:

Hawaii typically has the highest cost for electricity in the nation. The national average was 11.43 cents a kilowatt-hour in January, the most recent numbers available from the U.S. Energy Information Administration.

KIUC will not own the Green project They have a PPA with Green, a Purchase Power Agreement.

And yes there will more than likely be a substation built on the property. How else will the energy be converted to actual grid voltage. All the Green Energy Portfolio projects on the island need to be tied to a substation.

Regarding selling power. You need to be a Utility Company to re-sell or retail power. Power producers cannot cross TMK's with wholesale power.

Is KIUC up for a full disclosure?

It's easy to hide or spend profits and spend things on luxury items that aren't needed but got so much money gotta hide the profits.

Remember the county of Kauai fake furloughs that had the county at a surplus of 40-60 million. It was quickly spent to make it seem that the county of Kauai was broke.

Is KIUC doing the same thing?
