Musings: Kicking the Can


The clouds, blue over the mountains, yellow-gray overhead, unleashed rain just as the sun shot broad breams over the horizon, moistening the dogs and me before drifting mauka as a band of black fringe, leaving us with a wide arching rainbow that beckoned us to approach, but remained just out of reach.

Prosecutor Shaylene Iseri-Carvalho, perhaps fearing the growing momentum behind Justin Kollar's campaign could push her bid for re-election out of reach, has apparently resorted to a telephone survey to assess her chance of winning.

Kauai residents reported receiving computer-generated calls from a Washington, D.C.-based phone number, 202-769-0865, that asked a series of yes and no questions, including: Have you lived on Kauai for over 15 years? Have you heard of Shaylene Iseri-Carvalho? Are you going to vote for Shaylene Iseri-Carvalho in the upcoming election? Are you male or female? Are you Caucasian? Are you over 50 years old? Do you make over $70,000 per year? Then there was something about whether the prosecutor should be able to fire an employee, along with a couple of others that escaped recollection.

Oh, and my personal favorite: Do you read blogs on the internet?

Actually, Shay should hope people are reading this blog, because at least then they would get accurate information. Otherwise, you know how things get garbled in the coconut wireless: “Ho, I hear Shay stay stealing county gas.” “Nah, nah, nah, she get busted for having one rice cooker in the carport.”

Speaking of getting busted, even Honolulu media picked up the story about Troy Haruki Hamura facing federal charges for selling unregistered guns and possessing a machine gun. Not only did the guy turn over 19 unregistered guns to federal agents, he has another 10 rifles and 20 handguns that are registered. And he's a postal worker no less.

Yet according to the Star-Advertiser

The court’s pretrial services recommended releasing Hamura on bond pending a determination of probable cause on the charges. Defense lawyer Keith Shigetomi said Hamura will work in his family’s business. His family runs Hamura Saimin Stand in Lihue.

So a guy who has unregistered guns up the yazoo gets bail, but Roger Christie sits in jail without bond as he awaits trial for running a cannabis ministry. Ya gotta wonder, is Hawaii more tolerant of firearms than marijuana? Or does the Hamura family name have something to do with the postal worker getting the equivalent of 30 lashes with a wet noodle?

I was looking at the June and July grand jury indictments here on Kauai, and of the 13 people named, all but two are facing drug charges. Most of them are for third- and fourth-degree promotion and paraphernalia possession, which means the people are users, not big time dealers. And nearly every day, the paper reports on someone being sent to jail for testing positive for drugs while on parole or probation. This ongoing criminalization of drug use is not only incredibly expensive for taxpayers, but it destroys individuals and their families.

I'd love to see someone in the prosecutor's office who is committed to developing meaningful programs that divert drug users from the criminal justice system and address the root cause of drug use, instead of asking for more and more money to keep prosecuting the failed war on drugs.

In the meantime, I was disappointed to read in the article about the “missing” $1 million in the capital improvement project budget (wtf?) that Mayor Carvalho won't be pursuing the adolescent drug treatment center again this year. It's been like, what, over a decade now? Yup, let's just keep kicking that can down the road.....

Speaking of which, next time you hear the crack of thunder, it's not angels bowling, as I was told as a kid, but the sound of dominoes falling. Seems a Harvard University study published in Science has found that severe summer thunderstorms — the kind we can supposedly expect more of due to global climate change — are threatening the ozone layer, which protects the planet from the sun's ultraviolet rays.

As the The New York Times reports, the water vapor interacts with ozone-destroying chemicals that remain in the atmosphere from CFCs, the refrigerant gases that are now banned, but still linger.

This problem now is of deep concern to me,” Dr. [James] Anderson, [ atmospheric scientist and lead author of the study] said. “I never would have suspected this.”

Mario J. Molina, a co-recipient of a Nobel Prize for research in the 1970s that uncovered the link between CFCs and damage to the ozone layer, said the study added “one more worry to the changes that society’s making to the chemical composition of the atmosphere.” Dr. Molina, who was not involved in the work, said the concern was “significant ozone depletion at latitudes where there is a lot of population, in contrast to over the poles.

Meanwhile, in another blow against factory farms, an article in Science Now reports that researchers have discovered that vaccines used to prevent viral infections in chickens are apparently making them sick. It seems that two virus strains used in the vaccines may have recombined to form a new, vaccine-resistant virus that is sickening and killing the animals.

It may be too late to reverse global climate change, and its related damage to the seas and ozone layer, but it's certainly not too late to stop raising animals in unhealthy and inhumane industrial-scale settings that harm their health and ours.

  4. It would be interested to know who is funding all of Shay's campaign. She is doing all that she can, even this is not so surprising. Shay is so desperate that she is throwing hail mary passes to regain her failed position. Is her donors POHAKU participants? Is her donors mostly GOB's? Was her donor Hamamura?

    Surprises to the illegal unregistered guns on Kauai, no so? how many years has Hamamura been in the fast and kauai furious gun trade? Law enforcement only gets him when feds are involved.

    Crimes and Drugs are out of control on Kauai that's why Shay has a proven record. I will vote for change, Justin Kollar is the choice for me. No Shayme

  38. When I saw that email from Shay that she was gonna drop prosecution of the the horse case over a humane society employee she does not like, KOLLAR got my vote right there.

    "We will not bringing Dr. Rhodes back and cannot in ethical conscience proceed [prosecuting this case of animal neglect] when you have not resolved the issues regarding your employee."

If Shay wins the election after she abused the power of her office by fabricating the charges against Tim Bynum, unethically pressuring the Humane Society to fire an employee, illegally contracting with Strategic Justice to run the Pohaku program, illegally using Pohaku as a campaign tool, poorly managing her office, traveling excessively, appointing an inexperienced okole kisser as her first deputy, unethically taping witnesses, etc., you can blame the Garden Island.

  57. Bynam is a slug. He should not get re elected. I surely will not vote for him. But that doesn't excuse Shay for going after him on BS. Shay may have been wrong, but Bynam is still a lousy councilman. Bynam was on a witch hunt, going after Kaipo then Peter Nakamura,so he kinda deserved what he got. I don't buy the poor Tim crap.   58. Shaylene put taxpayer funds at risk (possible lawsuit by Bynum) when she had him charged criminally for a rice cooker (and wasn't it his tenant's?). All to satisfy her personal hatred of him. So Shay is to blame for any "payback." Shaylene overestimated her cleverness and underestimated Bynum's ability to get competent representation. Or maybe she didn't think about possible consequences at all. She just fed her rage; and got others in the County - namely, some Planning dept. employees - to assist in her master plan to bring down Bynum.

    Any out of all the terrible things Shay has done as Prosecutor, to the general public, the Bynum matter is the most egregious. It almost reads like a Shakespeare tragedy - her attempt to bring down Bynum may be the main reason for her downfall.

  59. The public record speaks for itself, Kaipo abused power and withheld information. Bynum and Kawahara called him on it and he attacked. Reasonable people agreed he went too far and he lost the election.

    The County paid a large settlement related to Peter Nakamura's ongoing harassment of a former girlfriend who dumped him and was paid $50.000 for unused vacation, something no other County employee coud get. I guess his $114,000.00 salary wasn't enough? Bynum and Yukimura felt that was enough to not support his reappointment to County Clerk. To me it sounds like doing your job not a witch hunt.

  60. Tim is not perfect. But at a minimum he deserves to be reimbursed for his attorney's fees in defending against rice cooker gate and his sleepless nights.

    Ask yourself what you would do if Shaylene had you wrongfully charged with a crime because she hated you. Think you might want to collect your attorney's fees? Yeah, I think so.

    If you have to pplead the fifth and ask for representation, that to me seems like you have something to hide and committed something that is criminal in nature.

    All her former subordinates in the OPA were liars and the whole county of Kauai attorneys are out to get her. I highly doubt that but if so Karma is the best equalizer, what goes around comes around.

  64. If the ODC suspends Shaylene's license to practice law, she cannot be our Prosecutor. And First Deputy Jake Delaplane isn't qualified under the Kauai Charter to serve as Prosecutor. So then what? I think Mayor appoints Prosecutor.

    It all goes back to the KC Lum purge. Kaipo did SHOPPO's bidding in going after Lum by filing the original ethics charge (originally on council letterhead but then he said it was as an individual because otherwise it would be an ethics violation of his own) and then using his clout to get rid of Lum and install Perry who was SHOPPO's original choice as chief

    Kaipo protected Mel in the ES-177 case (where it all started) where Mel "went off" on Lum and how SHOPPO's head (Brian Ponce) wanted him out. Shay and Mel are the tightest of political allies and so Shay supported Kaipo (in supporting Mel) in the Lum-Perry mess, even voting to allow the alteration the ethics board's judge's actual ruling, keeping the exoneration parts secret, going so far as to refuse to accept, into the public record, leaked versions of it from the public.

    Kaipo, Mel and Shay were mainly responsible for SHOPPO (under Ponce) getting Perry in after the Police Commission, under Ching and Furtado, acted way too independently in selecting Lum over Perry. So SHOPPO's leadership is paying Shay back no matter what the rank and file want.

  66. Hopefully SHOPO will fully stand behind Shaylene - and give her a job if Justin wins. Maybe Chief Perry can keep her from abusing County travel and vehicle privileges, targeting her enemies, and make her buckle down and do real work. Good luck with that one!

    At least Chief Perry would rest easy knowing Shay would always be willing to go to a Council meeting in his place.

    KIUC is another example of what's wrong on KAUAI. All of these problems can be fixed. We just have to get rid of the dirty corrupt people and replace them with educated and motivated people that will make a difference.

    1. If you are the Sgt on duty the responsiblity of the your subordinates actions fall upon you.

      If you are the PA and a program called Pohaku failed to follow the procurement process then you are held responsible.

      If you are the Mayor and gas is being stolen from county pumps and you are one of the culprits then you are held liable for your action.

      If you are the Chief of police and your department hasnt solved a murder case and dangerous crimes as well as dangerous drugs run rampart in the community then you should have a bad grade and take on the failures.

      All we want is someone to be responsible and not point the finger, isnt this in the duties and responsibilities on the contract of the high salaried positions you all swore an oath to.

It's really a twisted situation because Kollars masters are apart of the GOB and Shay is a too ambitious GOB, the chief was another seperate player in the struggle for power and control but thought the best thing was to join the anti christ herself. At first you had 3 seperate powers battling each other but now you have 2 joining together so will the 3rd join the other 2 and create a super power. Now that would be complete evil for we have seen what happpens when Bush,Cheney, Rumsfeld joined forces. But a lot of people dont know of the 4th power, it's kind of confusing but you have to know the history of Kauai to understand the underworld syndicate mafias on Kauai.

    Andy Parx News on the old gambling house and the cops that robbed that place brings back memories of the sugar cane bodies and the word everyone was scared to say "syndicate(s)".
