Musings: Big Rewards

Going out into the pre-dawn darkness and looking up, my reward was a celestial pyramid, with Venus and Jupiter comprising the base and a gleaming sliver of moon the point. It's the 20th anniversary of Iniki, the storm that changed my life by rewarding me with insight: material possessions are essentially meaningless, and significant joy can be found in simplicity.

A review of public records shows that Prosecutor Shaylene Iseri-Carvalho has given significant pay raises to deputy prosecutors who are supporting her re-election campaign.

The most substantial increase went to Charley Foster, who received a 45 percent pay hike within six weeks of starting work for the Office of Prosecuting Attorney. Foster, whose pay rose from $70,000 on Aug. 1 to the maximum allowable of $101,066 by Sept. 1, has devoted considerable space in his Planet Kauai blog to campaign-related issues and topics that reflect favorably upon his boss.

Lance Kobashigawa, an attorney who has been licensed to practice for about a year, gave $300 to Iseri-Carvalho's campaign and has a Shay bumper sticker on his car. Iseri-Carvalho increased his annual salary from $80,000 on Aug. 1 to $95,000 on Sept. 1, taking him to a higher pay rate than a deputy who has more experience and a heavier case load, but who has not engaged in any campaigning. 

Jared Auna, who has been licensed about two years and attended Shay's July fundraiser, was given a raise that took him from $85,000 to the maximum of $101,066 — the same pay earned by a prosecutor with two decades of experience.

Foster denied rumored reports that he'd gotten a hefty pay raise. On Sept. 3, Foster left a comment on his blog, in which he stated:

I do not make $100,000 a year and I have not received any raise, much less "a $30,000 raise." Nor have I received any information that I am to get such a raise. I can only hope the rumor mill is better informed than I am. If so, great!

However, county personnel records show that on Sept. 1, Foster was making $101,066.

Foster's blogging had dwindled to just one post in May 2012 and none in June and July. But in August, shortly after he began working for the OPA, he stepped up the pace and published 19 posts, 11 of them addressing campaign issues involving Iseri-Carvalho and the OPA.

His August posts included Solette Perry's endorsement of Iseri-Carvalho, criticisms of the County Attorney in regard to the POHAKU investigation, clarifications about the special counsel hired to represent OPA in the POHAKU controversy, reprint of an article referencing the POHAKU investigation as a “political vendetta,” criticisms of me for exposing misinformation perpetuated by Iseri-Carvalho, and a flawed legal defense of Special Counsel Gary Slovin's opinion about POHAKU procurements.

Foster also posted coverage on the Council debate over OPA's victim-witness grant application, photos of the “public safety” meetings staged by Iseri-Carvalho and Councilman Mel Rapozo and the prosecutor's debate, a reprint of an article criticizing the County Attorney's treatment of Iseri-Carvalho and a disparaging reference to the credibility of my later confirmed report that four EEOC claims against the OPA had been settled.

By September, Foster was making references to County Council members who are “inherently hostile” to his boss, He also vigorously argued Iseri-Carvalho's position on the EEOC complaint involving Erin Wilson, to the point of presenting false information and making snarky comments about Wilson's credibility. For example, he claimed in his post headline that the “EEOC found no reasonable cause to believe that discrimination occurred” in the Wilson case. In fact, the EEOC had referred the case to mediation before issuing any findings at all.

On Sept. 8, he published a post that offered the prosecutor's take on the county's $120,000 settlement of a racial harassment claim brought against Iseri-Carvalho by former deputy prosecutor Shannon Weigel.

The post included outright fawning, emphasis added:

Shay also denies ever suggesting anyone should “assimilate into the culture,” insisting first of all that the word is entirely foreign to her vocabulary (Shay expresses herself in a thick, earthy pidgin creole sprinkled when necessary with legal terms of art, which, in the interest of full disclosure, I confess I find very cool), and denies second that she harbors any opinion that anyone should assimilate in any case.

The post also misrepresented an email from a judge as raising concerns about a conflict of interest with Weigel and her then-boyfriend, an attorney seeking court assignments. In actuality, the judge was supportive of Weigel.

And in defense of Iseri-Carvalho's position that the EEOC settlements were part of an election year conspiracy against her, perpetrated by the County Attorney's office, Foster wrote:

Clause IV of the conciliation agreement, titled “Disclosure,” states:

consent is hereby given and it is agreed that disclosure to the public of the terms and the agreement is explicitly permitted.”

This is the opposite of the venerable and usual non-disclosure clause in which parties agree to forego smack talk after the agreement is inked. Here, the county attorney “explicitly permitted” and, one assumes, intentionally invited the complainant to talk stink in the press about the OPA. The clause also gives the county attorney cover to do the stink talking he’s been indulging in the last few days at the OPA’s detriment in the press lately (see, e.g., the Civil Beat article linked above). 

In fact, it was Weigel who insisted upon the disclosure cause because she was adamant that the public and other county employees learn about the harassment she had experienced at the OPA.

Though the county Salary Commission sets the pay range for deputy prosecutors, the Prosecutor enjoys wide latitude in setting salaries for individual deputies.

    I'd write a blog for Shay for 100K a yr and I wouldn't need to use the OPA computers to do it. So I would save the tax payers money on electricity and internet fees, fire charlie and hire me cause I'm local.

    Shoot while we're at it, I can be your personal driver. So fire Jake and charlie and hire me for 100K, I can be your blogger and driver and we'll save the county 100K but don't send me to court because I have to book our worcations to wherever the rain bows.

I have no connection to OPA nor know any of these people personally, but your personal attacks is what makes politics on Kauai ugly. This has to stop.

    Sounds off - 1st year lawyers making 6 figures. Does any other OPA in the country pay 1st years even close to that?

    Don't like seeing my tax money pissed away. How can OPA claim lack of lawyers when it could pay two lawyers for every one it has on payroll.

    I just heard on the radio... an ad for the YWCA saying their mission is to end racism. Yet the Y is apparently supporting the candidate the Feds found was harassing based on race.

    And if Lisa A is making the same money as 1st year lawyers, then that would indicate unequal pay, as she has been a lawyer for years.

    And well, reading a deputy prosecutor's blog where he swears he did not get a huge raise, then reading that public records show the opposite ----- priceless.

  20. I feel bad for the attorneys who didn't get a raise? I wonder if they had a fair employee evaluation too let them know why they was doing a horrible job or not succeeding expectations? Or getting a raise? I hope it was on job performance and case loads (felony crimes) Not a political gain for Shay?

    Joan- I wish you had more insight and info on the attorneys case loads and what they do in the office so we know how our tax paying $$ are being spent?

    It looks like the attorneys with either $105-$95 should be working on felony crimes and doing jury trials? Are they? Who knows? Maybe Joan can find that out?

    According to NALP, the median entry level salary for a local prosecutor was $50,000 per year in 2010.

    Does Kauai pay out $101,000? Seems to be about double the norm.

    That is the job of the County Council, yet Iseri refuses to answer questions. JoAnn and Tim try and get attacked, by Shay, by Mel, by KipuKai and by bloggers who accuse them of a "witch hunt” The rest of the Council ducks and looks the other way.

    Hello.... Charley public record release said you got $31,000.00 raise on 9/01/12. Oh yea your right you do not make 100,000.00 a year. You make 101.066.00 per year. Lets see thats $8,422.17 per month or $49.30 per hour not bad I'm sure many on Kauai who ARE paying you would like that pay.

    More than 50% of the author's cosmic 'musings' appear to be devoted to excoriating a loathsome character named Shaylene Iseri-Carvalho. While I understand that she was an excellent trial attorney, she obviously isn't a skilled manager or administrator. Case closed folks!

    Yet, we all know that this Kauai obsession must continue. Why? Well because jilted, insecure, small-minded people are having so much fun ANONYMOUSLY trashing the local witch (and anyone else near her btw).

    These petty fools will, ANONYMOUSLY, tell us their purpose is to right a series of wrongs. How will they do this? It appears they will propound a greater series of wrongs in a flawed effort to fill their own emptiness.

    As for the cosmic author with an unfathomable obsession, she has abandoned journalism. She appears to feed her anonymous legion every witch rumor, every witch innuendo, as if it were fact.

    Let's examine the latest specific examples: The cosmic author 'reported' that "Justin Kollar won the most beautiful barong (shirt) competition at Saturday's Kauai Filipino Women's Club Terno Ball, prompting his political opponent, Shaylene Iseri-Carvalho and her entourage to walk out in disgust."

    I attended the Turno Ball, and personally know several of the individuals that were seated at the table with Ms. Iseri-Carvalho. To refer to my friends as part of her or anyone else's entourage is beyond a stretch. To 'report' that my friends walked out in disgust is an outright lie. Try check your sources, and your facts honey.

    Example 2: The cosmic author 'reports,' by insinuation, that the witch gave pay raises to deputy attorneys simply because they 'are supporting her re-election campaign.' Oh really?

    While raises were clearly given, the cosmic author insists it could only be because these individuals support the witch's campaign. Hmmmm. Again did the cosmic author investigate anything or interview anyone? Does the cosmic author know the relative value of any deputy prosecuting attorney? I suspect the answers are no, no, and no. Great journalism.

    It's no secret that the witch leaves a lot to be desired with respect to personnel matters. She's clearly way off. What then is the alternative?

    Well, not surprisingly it's the cosmic author's favorite pasty puppet from the county attorney's office. Oh good! That's a clean organization isn't it. And gee, I wonder how much money the puppet makes "representing the police department." Haha what a laugh.

    If you folks want to right another series of wrongs, let me give you a tip: try also investigate your darling pasty puppet, and his handlers, with the same zeal with which you attack the witch. Never mind the fact that the man is clearly and unabashedly unqualified.

    Try ask yourself this: if you were a criminal defendant, would you rather face the witch or the pasty puppet as prosecutor? It's a no brainer. Perhaps that's the reason the witch must be trashed no matter who else gets trashed along the way. There is nothing to recommend the pasty puppet, except to say "well at least he's not her."

    Nah nah nah forget it. Just keep doing as you have been oh cosmic author and anonymous legion, as that will reflect a true image of your empty Kauai obsession.

    Just egnore that Jared has gone to all Shaylene's fundraisers and his daddy is a sitting Judge. Jared's caseload is misdemeanor jury demand cases. Clearly misdemeanor crimes are more important to Shaylene than Home BURGLARIES and serious THEFT cases that Rebecca handles, and since Jared is a rookie Attorney, the raise above Rebecca's salary and equal to the seasoned experienced DPAs in the office will give Jared the confidence boost he needs to win those misdemeanors.

    Her downfall, should it come to pass, would seem well-deserved.

    On a 1 - 10 scale of tragedy, her downfall will rank as a 1 at most.

    The larger "tragedy," (perhaps a 2 at most) will befall those associated with her, who through no fault of their own (with 1 arguable exception), will experience another downfall.

  48. Wow Joan, did you see the press release on the County website today?
    Shaylene is once again raiding money from the cold case unit grant fund for a free mainland trip.
    According to her press release on the Unit, 2 experienced DPAs would be assigned to the unit to help solve these cases. So who is the experienced DPA that she asssigned and who has she chosen to go on the trip with her? Is it one of the 3 DPAs who actually have prior experience doing murder trials (2 as Defendant's Attorneys and 1 as a DPA)?
    Is it even an experienced DPA?
    Shaylene ...drum roll please...of course (instead of an experienced trial dpa) has decided to assign and take her Vegas traveling buddy, Jake (perhaps to carry her baggage).

    So OPA expenses picked up by Cold Case Unit grant thus far?
    Airfare to Vegas for two. Check.
    Vegas training fee. Check
    Car. Check.
    2 Hotel rooms. Check.
    Per Diem (well county tax payer pays that. check).
    Airfair for 2 to New York.
    New York training and lodging fee for 2.
    Car.
    Per Diem.
    No wonder she "vigerously" fought to get the funding! Two free trips to the mainland in a matter of months. Wow and Auwe.

  51. Lost in all this, is the (uncomfortable for this blog) fact that horrible Shay has built the best team of prosecuting attorneys that the OPA has seen in the last 16 years, if not ever. That being said, can anyone on here honestly say that Mr. Koller is qualified, or will we be relegated to 55 more days of negative campaigning by his surrogates. With 18 months as a prosecutor (the vast majority spent in district court traffic), Mr. Koller ranks in experience somewhere in between Mr. Auna and Mr. Koboshigawa, each of whom have been unjustly thrashed on this blog. So, if 2 year deputy prosecutor Auna isn't worthy of a raise, how are we to justify 18 month deputy prosecutor Koller as the chief law enforcement officer on this Island. By any standard used on this most enlightened of forums, it doesn't add up. Auna should replace Shay because he is 33% more experienced than Koller.

  57. "Lost", The issue with the raises is about fair and ethical treatment. Shaylene's actions show she is motivated by political payback or benefit (campaign for Shaylene equaled raise, no campaign equaled no raise), or even gender bias (everyone who could get a raise got one, but a female). Why is she paying an inexperienced dpa more than one with more experience and more serious cases? Why is Shaylene giving raises right before the election?
    If someone shows they cannot be ethical or fair they do not deserve to be the Prosecuting Attorney for the County.
    Only two people are running for this election and it comes down to the lessor of two evils.

    A manager with less experience is better than an experienced manager with serious ethical issues.

    That parole officer, Debra Murell and some other people fought the courts' top guys, supe, a handful of judges, Gorilla Pimp Richy,and Richy's/Spear's prostitute who went after Debra.

    Like Mr. Moore, Debra could've been k*lled by Gorilla pimp & prostitute. Richy/Prostitute nailed Debra as an informant for KPD. Solicited thugs to do their dirty work to k*ll her. Like Monica Alves, who's behind bars forever now for murder of an informant.

    Big shake down in courts. Judge and high ranks gone unexpectedly. Gorilla/prostitute under magnifying glass.
