Musings: Odds and Ends

This morning it was all about the clouds, as in pink-purple wisps draped over a lavender Waialeale, a bank of towering puff balls on the horizon etched in red-gold as the sun climbed behind them, shooting scarlet shafts skyward, until it finally emerged, casting a dazzling path of shimmer upon a glassy, warm sea.

And all the while my head was swiveling from mauka to makai, taking in all that beauty, as the birds added their voices to mine in singing praise.

Some Kauai folks are getting together tomorrow afternoon to join their voices in calling for the repeal of Act 55, the legislation that created the Public Land Development Corp. It's part of a Hawaii-wide day of action, with the other islands staging their own events. Here, the rally is set for 2 to 4 p.m. in front of the historic County Building on Rice Street. John Cruz will be performing at the opening.

Speaking of the PLDC, I've been meaning to report a little nugget I mined from Gov. Abercrombie's meeting on Kauai. DLNR Director William Aila said he is in discussions with the Navy about the five-mile stretch of beach between Kekaha and PMRF that's been closed since 9-11. He said he couldn't make an announcement yet, because negotiations were still ongoing, but they were looking at property boundaries. Maybe we'll get the beach back.

In other news, I just learned yesterday from a woman who used to work with state parks that Roundup is regularly sprayed along the Kalalau Trail to keep the vegetation back. I don't know about you, but that's not something I would expect in a wilderness park.

I also found out that Prosecutor Shaylene Iseri-Carvalho has none other than her first deputy, Jake Delaplane, serving as her campaign chair. Her treasurer, Kerrileen (Nani) Lizama, is also an employee of OPA, serving as Shay's "program assistant” in charge of overseeing diversion programs. Cozy.

And on Wednesday, it seems the state Campaign Spending Commission will be considering:

*Docket No. 12-12 – In Re the Matter of Shaylene Iseri-Carvalho – A complaint by Diana Gausepohl-White against Shaylene Iseri-Carvalho for the failure to report in-kind contributions.  The Commission to conduct an initial determination of the complaint in accordance with HRS section 11-404 – i.e., summarily dismiss the complaint, investigate further, make a preliminary determination of the existence of probable cause to believe a violation of law has been committed, or refer the complaint to an appropriate prosecuting attorney for prosecution.

Hmmmm. Too bad they don't have those dockets on line. Wonder if it's about those POHAKU goodies.....or the promotional blogging services.

Speaking of POHAKU goodies, Councilwoman Nadine Nakamura noticed a little glitch in the prosecutor's request for $35,000 for Keiki POHAKU. It seems the RFP (request for proposal) for a service provider specified the program would not cost more than $17,600. So what was the rest of the money going to be spent on, Nadine asked Shay, who replied, “promotional materials” and “training” and you know, like if the kids needed gloves to perform community service.

Oh, really? As Nadine noted, such expenses should be included in the RFP, since they would be borne by the program provider. What I'm wondering is why promotional materials are needed for a diversion program. It's not like you have to market it, since the referrals will be coming from the OPA.

Besides, surely Shay must have some promotional goodies left over from the adult POHAKU program, considering she bought thousands of items — tote bags, whistles, wrist bands, rally fans, etc., etc. — for a mere 50 participants. Unless, of course, the stash has dwindled during her re-election campaign.

And people wonder why some Councilmembers ask questions before they give Shay money.

I wondered why Shay needed POHAKU promotional items too. It'd be like the Judge handing out trinkets to defendants when they're sentenced. "Here, I'm sentencing you to prison, but take this pen and shopping bag with you so people will know that I sentenced you for breaking the law."

And it's all politically motivated! The entire world is out to get her.

Great job by Nadine and Joann for asking the tough questions and bringing out more deception by the PA.

Mrs Gausepohl-White and the rest of the OPA that is in the Hornets nest are commendable in their stance to fight against a tyrant.

To all of you who now toe the line and seek the End of Corruption on Kauai, I say Thank You.

We must continue to keep a close eye on our officials and never be fearful to question them even as they plead the fifth and hide behind executive session.

Nakamura seems to like to create the impression that sheʻs busy busy busy and doing some serious fact finding.
I heard her mention that 17,000 and then thanked the woman that testified for bringing it up; I never heard the testifier mention that and I listened very carefully to that meeting.
SO maybe itʻs some kind of game going over there. And as far as Joanne asking ʻtoughʻ questions, I wouldnʻt describe them like that. More like irrelevent delay tactics that are fishing expeditions (catch and release kine) for the purpose of trying to sound diligent.
How come she never kills us with this kind of questioning on big grants?

What are you talking about? Nadine brought that up after looking at the RFP. Go back and listen at 3:25:00 on the council video.

Also, what's with the "us?" Must be a comment from Charley, Shay or Jake.

Anthony Sommers must be laughing as he drinks his Arizona Ice Tea! There will be another book written, that book will provide knowledge on how to survive while living or visiting Kauai. The book KPD Blue and ES 177 is a mere tease to what the people of Kauai has known and the truth will set Kauai Free from the GOBAG.

Joanne and the rest of the county council knows the fraud, waste, and abuse that went on the POHAKU program. Shayme wants to hide the truth about Pohaku like ES 177 because if the public found out then they would be shocked and awed.

The promotional expenditures, the position that was created without approval, the favortism of participants with family ties to get into pohaku, the immunity to do community service when the PA says it was one of the main criterias implemented in the pohaku program.

There are many more abuses that went on that the general public needs to know before the election. Her only play for being reelected is to not have this program before the election and to divide the island of Kauai as making it as a haole versus local thang.

She will get her wish as not having a thorough investigation done prior to the election because she has close ties to the Kauai BOE. The link has some serious deadly connections. The Boogie Man is real people and the Evil is as historical as its tales.

Her office is full of friends and family, ask her who is Nani Lizama, the one helping safeguard the funds of the grant that was just awarded to the OPA, and Jackie Alapai, the chick that answers the phone, NIECES! Qualified, I think not!

There were some goodies getting passed out in the courts, ask around,like ask the para-prostitute.

Alapai? Sure, Alapai is related to Shay. Shay's mother married Alapai. Shay lives next door to her mother and step-father.

In the same spirit, I would suggest that planning get some tote bags with 'CZO' across the front and definitions of a Kitchen, and a Multi-family dwelling on the back. Just to help OPA out in their next criminal zoning prosecution fiasco.

I know who that PO (probation officer is) saw her at a OPA meeting groveling to Shaylene but on this site she tears her to shreds. Go figure.

AMazing how someone like that could have been an officer of the court.
Imagine a probation officer that goes around bad mouthing the people sheʻs assigned to oversee.Something real wrong with this in the ethics arena. Could ruin someoneʻs life having a PO like that but theyʻre supposed to be there to help people get back on track.

Confused as Heck!

First it is said that once the grant is approved then the OPA will have an outside agency to handle the keiki program.

Then there's testimony stating that KPD would be involved and that they must find ways to pay for officers to support this program or have officers paid over time to do it. It's like the KPAL program where instead of volunteers in support of a community program, officers want to get paid for extra cirricular activities while on duty.

Then the PA and her hot head 1st Deputy states that they will have a coordinator and a 3 person board in the OPA that will not have any experts or qualified people in making decisions on who qualifies into this serious and repeat offender program called keiki pohaku. Note only Felony and offenders that keep on commiting the same crimes over and over again will be referred to this program. Example someone who had been breaking into homes and stealing all of your personal things that you have worked hard to earn. A kid can kill someone and probably be qualified to enter in the program if they have connections.

Then we find out that all of this 35k is not going to be used in the start up to the program. Only about 17k so where is the other 17k going to? And that's where we find out that the PA plans to use that as she pleases. We all know what that means and if you do not know about the fraud, waste, and abuse of the adult pohaku program then you need to ask somebody.

So there's many questions still unanswered and there's is similarities to the past abuse by the PA that questions her motives on having this program inplace while there is already numerous rograms that protect and rehab the children of Kauai. How do the PA and KPD plan to implement this program when they are under staffed and with such a small amount to start this program up, what is the total cost to sustain a program and what kinds of qualified positions are they going to need to support this program. What is going to be the annual cost and what measures will be taken to show a succes or failure rate of the participants. How is the county going to protect itself from liabilities and what is the exact goal of this program.

It looks like a complete failure from the looks and listening to the speakers who support this program. Not one could actually state facts, just I like it because I was paid to be here to support something I know nothing about. I think everyone wants a piece of the pie and greed will be doled out to the Powers.

If the people of Kauai could have the facts about the adult pohaku then we would have a better understanding if the program was a success or a failure, but as we know the Shayme PA has plead the fifth on answering any questions regarding the adult pohaku. Something is not right when a person hides the truth and is unwilling to bring forth factual evidence to support their claim that Pohaku is a Positive Optimism Helps All of Kauai Unite. A kid that is proud of their report card has No Shayme to Show their good grades and a Kid with bad grades, well we know what they do!

Many of Kauai Public Defenders and Pro Bono attorneys set their defense clients up for failure because it is already planned out in chambers with some corrupt judges. They conspire and are in collusion to suppress evidence and violate peoples constitutional rights because they know they can get away with it on Kauai. It is the biggest criminal network in the State of Hawaii and there's so many people who sworn oaths to uphold the Federal, State, and County of Kauai Laws and Constitution that are involved.

Being apart of the GOBAG does not give any Judge the right to violate judicial ethical behaviour as well as violate a persons bill of rights.

It's really telling that the best the Pro-Shay contingent that comments here has been able to do is throw out really vague accusations about Justin's campaign treasurer, with no actual proof or specific charge of anything, and the County Attorney contributing to Justin's camapaign (though they so willingly overlook the donations that Shay's deputies have made to her, and the huge raises some of them have since recieved)
